RENTAL TERMS AND CONDITIONS

In the conditions set out herein, the service provider (rental owner) shall be referred to as “the Owner”, and the client as “the Tenant”.

In the event of a booking made through a third party (various booking platforms, Airbnb, Booking.com, etc.), the Terms and Conditions of that third party shall take precedence over the Owner’s Terms and Conditions. The Owner’s Terms and Conditions shall then be considered as General Rental Conditions (GRC) and must also be complied with.

I. Purpose of the Rental

A rental agreement is tacitly established between the parties through communication of the rental conditions. The purpose of the rental agreement is a short-term rental of guest rooms. Accordingly, the parties agree that their respective rights and obligations shall be governed by the stipulations of the contract, the amended decree of 28 December 1976, and, in the absence thereof, the provisions of the French Civil Code.

The number of occupants indicated for each property in the rates listed on the website www.gite-troglodyte-amboise.fr or on other online platforms corresponds to the maximum authorised occupancy given the available equipment. This number cannot be exceeded for safety and insurance reasons.

II. Designation of the Accommodations

A semi-troglodyte furnished tourist accommodation located at 14 Ruelle Sautard, 37400 Amboise.

s online distribution platforms.

III. Booking

The rental is considered firm and final upon receipt of the deposit or full payment, depending on the booking date and the check-in date. In the event of non-payment or late payment, the Owner may cancel the booking.

Upon receipt of payment, the Tenant will receive a confirmation email within a few days containing practical information regarding the stay.

IV. Rental Price and Charges

Rental prices are indicated either:

  • On the website of the intermediary (various booking platforms, Airbnb, Booking.com, etc.), or

  • On the Owner’s website for direct bookings (www.gite-troglodyte-amboise.fr) on the Reservations page and other online platforms.

All prices are inclusive of taxes and tourist taxes. Prices displayed on the Owner’s website do not include booking platform commissions.

The total rental price includes, for the duration of the rental, the payment of rental charges and the following supplies:

  • Water,

  • Electricity and heating,

  • Internet and television access,

  • Provision of bed linen and towels, unless otherwise agreed by the parties.

V. Payment Terms for Direct Bookings

For bookings made on the Owner’s website prior to the arrival date:

  • 100% of the total rental amount is payable at the time of booking.

  • Booking fees: none.

VI. Accepted Methods of Payment

Payment by credit card via the Owner’s website (www.gite-troglodyte-amboise.fr) is accepted.

VII. Duration of the Short-Term Rental

Regardless of the duration specified in the rental agreement, the Owner rents the accommodation to the Tenant for check-in from 17:00 (5 PM) and check-out no later than 11:00 (11 AM). The Tenant expressly undertakes to have completely vacated the accommodation by 11:00 at the latest. Check-in and check-out times may be adjusted exceptionally by mutual agreement, depending on the Owner’s availability.

Under no circumstances may the Tenant claim any right to remain in the accommodation beyond the period specified in this contract, except with the Owner’s agreement.

VIII. Child Safety

In both private and shared areas, children accompanying the renter must remain under their full supervision and responsibility.
The accommodation includes a mezzanine overlooking the living room. Although equipped with a safety railing, this area may present a risk for young children if left unsupervised.

IX. House Rules

  • Animals are not permitted in the accommodations.

  • The accommodations are non-smoking; smoking and vaping are prohibited.

  • Parties and events are not permitted. For the consideration of other residents, noise should be limited between 22:00 and 08:00.

  • Self-check-in is available from 17:00 (5 PM); check-out must be completed by 11:00 (11 AM).

  • Commercial filming and photography are not allowed without the Owner’s explicit written consent.

Before departure, the Tenant must:

  • Remove the sheets from the beds and fold the sofa bed.

  • Turn on the dehumidifier in the bedroom if it has been switched off.

  • Close the windows.

  • Clean and put away the dishes.

  • Place the rubbish in the bins located opposite the accommodation, in front of the pine trees.

X. Modification, Assignment and Subletting

The rental agreement is concluded intuitu personae in favour of the identified Tenant only. The rental cannot benefit third parties without the Owner’s prior agreement. Any transfer, total or partial subletting, or any other provision of the property, even free of charge, is strictly prohibited and may result in termination of the contract.

The Tenant may not make the property available, even free of charge or as a loan, to any person outside their household. The full rental amount remains due to the Owner.

Any requested modifications regarding dates, location, duration, number of occupants, or family composition must be approved by the Owner and may incur additional charges.

XI. Inventory / Condition of the Premises

The Owner shall provide the accommodation in a condition conforming to the description on the website (www.gite-troglodyte-amboise.fr) or other online platforms and shall maintain it in good order.

Cleaning is carried out by the Owner, and the Tenant is required to return the apartment in a proper and orderly condition, respecting the premises.

As hosts, we commit to providing a clean and tidy accommodation. The Tenant is expected to respect basic hygiene and communal living standards.

XII. Charges for Damages

If the Owner observes significant damage, it may be charged at an amount determined by mutual agreement between the Owner and the Tenant. In case of dispute, a professional or authorised body will provide an estimate, either requested by the Tenant before departure or by the Owner at check-out. Damages must be reported to both the Owner’s and Tenant’s insurance.

Additional charges may also apply:

  • For stained or unusable linen: €10 per towel and €20 per sheet.

  • For failure to return the premises in the same clean and tidy condition as at arrival: €20 per additional cleaning hour (3 hours already included in the cleaning fee paid at booking).

XIII. Cancellations for Direct Bookings

By the Owner:
In the event of cancellation by the Owner, the Tenant shall be refunded all amounts paid in advance.

By the Tenant:

  • 100% refund of the total amount paid if cancellation occurs within 24 hours of booking or at least 14 days before arrival.

  • 50% refund of the total amount paid if cancellation occurs between 14 days and 48 hours before arrival.

  • No refund for cancellations made less than 48 hours before arrival.

Furthermore, if the Tenant does not arrive on the scheduled check-in date and does not make contact within 24 hours, the rental agreement becomes null, the Owner retains the accommodation, and all amounts paid remain with the Owner.

During the stay, if the Tenant cuts short the rental period, the full rental price remains due to the Owner; no refund will be issued.

The Tenant is free to take out cancellation insurance of their choice.

XIV. Insurance

The Tenant is required to insure the rented property under liability coverage for themselves and all occupants. The Tenant should verify whether their main home insurance policy provides holiday rental coverage (multi-risk insurance) to cover rental risks such as water damage, fire, etc.

If not, the Tenant must contact their insurer to request an extension of coverage.

The Owner may request a proof of insurance upon check-in.

It is recommended not to leave valuables in the accommodations.

XV. Termination by Right

In the event of the Tenant breaching any of the contractual obligations set out in these Terms and Conditions, the rental agreement shall be terminated automatically without prior notice.

XVI. Domicile Election

For the execution of these Terms and Conditions, the Owner and the Tenant shall elect domicile at their respective addresses.

However, in the event of a dispute, the Consumer may bring proceedings either before a territorially competent court under the French Code of Civil Procedure, or before the court of the place where they resided at the time of the contract’s conclusion or at the time the damaging event occurred.

XVII. Commercial Complaints / Dispute Resolution

Under French law, for any commercial dispute, the Tenant may initiate a mediation procedure as follows:

  • If booked via an Online Travel Agency (OTA) such as Airbnb or Booking.com, the Tenant may submit a complaint through the OTA’s website.

  • If booked directly through the owner, the complaint must be sent by registered mail with acknowledgement of receipt within 15 days of the stay to: Daniel Troufflard, 16 Ruelle Sautard, 37400 Amboise, France.

The owner commits to respond within 15 days.

If the response is negative or unsatisfactory after 15 days, the Tenant may refer the matter to a consumer mediator.

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, any consumer has the right to free access to a consumer mediator to resolve disputes with a professional, in this case the owner. The Owner guarantees effective access to a consumer mediation system. The procedure for mediation is detailed by French Government decree.

XVIII. Internet Use and Trust Charter

No illegal downloading of copyrighted works, and no visiting websites with prohibited content such as pornography, pedophilia, racism, incitement to violence, or violations of human dignity.”

By this agreement, the Tenant undertakes to respect the HADOPI law. The Tenant commits on their honour to comply with this charter and releases the Owner from all liability regarding their use of the internet, whether directly or indirectly. The WIFI access code is personal and may not be shared without the Owner’s consent.

The Tenant is responsible for the use of the internet provided during the rental period. Browsing is entirely at the Tenant’s risk. It is prohibited to access internet pages containing illegal or prohibited content. All online activity is recorded and may be verified in case of suspected abuse.

The Tenant undertakes not to use the internet connection to reproduce, distribute, display, or communicate copyrighted works or objects (texts, images, music, audiovisual works, software, video games) without authorization.

The Tenant is informed that peer-to-peer software may automatically share downloaded files when connected to the internet. Such software should therefore be disabled to prevent copyright infringement.

The Tenant must also comply with the Owner’s network security policy and rules for use of IT equipment. The Tenant may be held criminally liable for copyright infringement under Article L. 335-3 of the French Intellectual Property Code.

Copyright infringement: any reproduction, representation, or exploitation of an object protected by intellectual property rights without the rights holder’s permission or the law constitutes infringement, punishable by up to 3 years imprisonment and a €300,000 fine.

The Tenant acknowledges that they are solely responsible for internet connections during their stay. Use of the access codes and signing of this contract constitutes agreement. In case of legal violations, the Owner is obliged to provide the Tenant’s details to the authorities.
